Nadchodzą istotne zmiany w opodatkowaniu nieruchom*ości. Czego mogą spodziewać się przedsiębiorcy w 2025 r.?
Kluczowa będzie zmiana definicji budowli. W przeszłości Trybunał Konstytucyjny zgłaszał swoje wątpliwości w stosunku do tej definicji. Mimo to, do tej pory ustawodawca nie wprowadził zmian w przepisach. W najnowszym wyroku TK orzekł już wprost, że definicja budowli stosowana dla celów podatku od nieruchom*ości jest niezgodna z konstytucją. W związku z tym nowa definicja musi zostać wprowadzona najpóźniej na początku 2025 r.
Znany jest już projekt nowelizacji. Wynika z niego, że autonomiczna definicja budowli oparta będzie na 5 kategoriach obiektów kwalifikowanych jako budowle, z nadrzędną rolą załącznika zawierającego listę budowli.
